Pre-Board Checklist

• Operator MUST be at least 30 years old to rent the pontoon and have boating experience.
• NO MORE than 8 people maximum on the pontoon (10 people for 24’ Tritoon), including the Captain if hired.
• All children 12 years old and under must wear a safety (life) vests at all times while onboard.
• NO towing of tubes/wake boards/ski’s/etc.
• Mariners Sun Harbor pontoons allowed in the Barnegat Bay only.
• Boundary Limits: Ship Bottom to BB Buoy Forked River (no Tices Shoal).
• Dock and Dine is permitted. You must call ahead to confirm rules with dining establishment.
• Do not follow each other or any other crafts. Maintain a SAFE speed.
• Stay 50 yards from any objects and stay 50 yards off any shoreline.
• Pay attention to the TIDES!
• Give other vessels the right of way and maintain a proper look out.
• Look before you turn.
• NEVER operate craft after consumption of alcohol or drugs. Mariners Sun Harbor reserves the right to inspect the renter’s coolers for excessive alcohol.
• Fishing and crabbing is not permitted on the pontoons. Pleasure cruising ONLY!
• An automatic $100 cleaning fee will be charged to the credit card on file if boat is excessively dirty or garbage is left onboard at time of return.

Safety & Training

I have received and understand the instructions in safe boating covering the United States Coast Guard
Navigation Rules, Equipment Requirements for class A vessels, and operation of personal watercraft.

R/O shall obey all federal, state and local laws, ordinances, rules and regulations, with respect to the
use and operation of the pontoon and shall obey all lawful directives of the Mariners Sun Harbor staff.

R/O shall close and secure all doors, with all riders inside the panel walls before the pontoon begins moving and remain closed while underway.

R/O and passengers shall not at any time put any body part(s) outside the panel walls while the pontoon is in motion; this is against the law and extremely dangerous.

R/O shall follow all posted speed limits and rules of navigation while on the water and shall stay clear of all other boats on the water. R/0 shall not attempt to board another vessel from the pontoon or tie off to another boat. R/O shall take care not to allow the pontoon to collide or damage other vessels or docks. R/O shall place the bumpers on the outside of the pontoon before attempting to dock the pontoon.

R/O shall not allow anyone other than the R/O to use or operate the pontoon other than those who have signed the participant check out acknowledgment. If R/O fails to disclose other operators or users of set equipment they will be personally liable for any damages to the undisclosed individuals even if such
damages arise out of the negligence of fault of Mariners Sun Harbor.

R/O shall not, except in an emergency to return, place fuel in the gas tank from a source other than the Mariners Sun Harbor.

R/O shall not let anyone to swim, ski or ride tubes behind the Mariners Sun Harbor pontoons.

R/O shall not allow any part of the pontoon to come in contact with any part of the shoreline, or to “beach” the pontoon on any surface, such as a sandbar. Should this happen by accident or fault, R/O will be held responsible for any damages incurred and/or fees should assistance be needed to become
“unstuck”.

Responsibility of Damage

Responsibility Damages: R/O shall return the pontoon, in good working order and condition, at the end of the rental. If any equipment has been lost or damaged during the rental, the R/O shall inform the
Mariners Sun Harbor staff immediately. R/O shall be financially responsible for all lost or damaged equipment or damage to the pontoon. Mariners Sun Harbor will charge the R/O for lost or damaged
equipment to the credit card on file according to the following schedule of ESTIMATED charges.
• Totaled Pontoon $50000.00
• Propeller $500.00
• Ladder $200.00
• Fire Extinguisher $50.00
• Damage to Lower Unit: up to $5,000
• Anchor $150.00
• Dented/Scratched Panels $250 each
• Torn/Stained/Damaged Seats $250-$650
• Broken Navigation Lights $50-75 each
• Dock Lines $20.00 each
• Radio/Speakers $500 each
• Life Jacket $25.00-50.00 each
• Depth Finder $1000
This list of charges is not exhaustive and not a waiver of responsibility for other damages to the pontoon and R/O shall be fully financially responsible to Mariners Sun Harbor for damages incurred. If pontoon is returned in a non-rentable condition as determined by Mariners Sun Harbor staff, R/O agrees to pay
Mariners Sun Harbor additional rental fees of $300 a day until the pontoon is available to be repaired to a
rentable condition with a maximum rental charge of up to $6000.

I. Acknowledgments and Agreements: By exhausting this pontoon rental agreement undersigned R/O acknowledges and agrees:

A. Although R/O may receive general instructions on these forms and from Mariners Sun Harbor staff
prior to rental; acknowledge that the instructions received do not qualify as watercraft operation training
or safety training. The staff are human and the amount of information that be provided prior to the R/C Is limited. There is no amount of instruction which can prepare an individual for all the foreseeable risks associated with operation of watercraft. There is also no substitution for common sense. R/O
acknowledges these limitations and agrees to assume all risks associated with operation of the pontoon.

B. R/O acknowledges and agrees that they have the requisite skills and physical and mental ability, that is necessary for the proper and safe use of the pontoon, and swimming skills as may be needed in an emergency. R/O is personally liable for any injury or damage caused to others or their property while operating the pontoon regardless of whether in R/O party or third parties.

C. R/O agrees to inform their parties onboard to where safety (life) vests are located and how to properly wear them, along with throw able floatation devices. All children ages 12 and under onboard the pontoon MUST wear a life jacket at all times as per New Jersey state law and it is HIGHLY recommended that all parties wear safety (life)vests while onboard the vessel and underway.

D. R/O shall not sell or sign this agreement or sublet the pontoon to any part thereof, and at all times during the rental period, the person(s) listed as Operator shall be the person operating the pontoon, Mariners Sun Harbor provides a pontoon without warranty and any and all warranties capable of waiver
under no New Jersey law are here by waived Mariners Sun Harbor does not maintain or provide emergency personal services or watercraft.

E. Mariners Sun Harbor is not liable for the loss or damage of personal property to the renter, operator or any parties onboard said pontoon.

F. A major credit card authorization (VISA, MasterCard, or AMEX) or CASH deposit in the amount of five hundred dollars ($500.00) shall be collected and retained by the LESSOR as partial compensation for failing to return said rental craft in as good condition, ordinary wear and tear excluded, as when received; for reimbursement of articles damaged, missing or broken, or to be applied in addition to the base rental charges upon return of craft by RENTER.
